2019 Adm. John S. Jenkins Award Winner

In 2019, the Rear Admiral John S. Jenkins Writing Award for Law Students was won by James D. Cromley of Arizona State University for his essay, “In the Field or in the Courtroom: Redefining the APA’s Military Authority Exception in the Age of Modern Warfare.” The Administrative Procedure Act of 1946 abrogated sovereign immunity for most federal agency actions, but preserved it for “military authority exercised in the field in time of war.” In light of the recent case of Zaidan v. Trump (D.D.C. 2018) (the “Kill List” case), Mr. Cromley laid out evidence of legislative intent and occasions for judicial interpretation of this exception. His essay will appear in the December 2019 of the Arizona State Law Journal and is available on our Jenkins Writing Award page for interested readers.
